Terms and Conditions

The terms on which we admit and teach

The agreement between St. John's H.S. School, Barama and a student or prospective student — admission, documentation, fees, cancellation and conduct — together with the terms for using this website, the school app and Academica ERP. Written plainly, so a family knows where it stands before accepting a place.

Students and parents, and every visitor to this website

01

The agreement, and who it binds

These terms and conditions represent an agreement between St. John's H.S. School, Barama (the “Institute”) and a student or prospective student. By accepting the Institute's offer of a place in any class, you accept these terms in full.

Where the student is a minor — as most students of this school are — these terms are accepted on the student's behalf by the parent or guardian named on the admission form, who is responsible for the payment of fees and for the undertakings given here.

A contract, not a notice

Accepting a place in any class accepts these terms in full, for the student and for the parent or guardian who signs.

Documents complete the admission

An admission is complete only on full payment of fees and complete educational documentation, submitted within the time the Institute allows.

Fees are charged monthly

Service, registration and other charges are not refundable in any circumstance. Fees are refundable under the Refund Policy.

02

What forms the contract, and how it changes

These terms, along with the student admission and the Institute's rules, regulations, policies and procedures — and the most recently published prospectus, where applicable — form the contract between the student and the Institute in relation to the student's studies at the Institute, as amended from time to time.

Documents that together form the contract
DocumentWhat it covers
These Terms and ConditionsThe general agreement between the Institute and the student, as published on this page.
The student admissionThe admission form, the Provisional Admission Letter and the particulars recorded in Academica ERP.
Rules, regulations, policies and proceduresIncluding the general rules for students, the hostel rules and the policies published on this website.
The prospectusThe most recently published prospectus, where one applies to the class concerned.

Amendments

Any amendments made by the Institute to the contract will be made available on the Institute's website, which you should consult regularly. We shall take reasonable steps to bring these changes to the attention of affected students as soon as is reasonably practicable, ordinarily through the school app, a circular, or a notice on this website.

If two documents disagree

Where these terms and another published document differ on the same point, the more specific document governs — the Refund Policy on refunds, the Privacy Policy on personal data, and the General Rules on conduct — and the Institute will correct the inconsistency when it is brought to notice.

03

Admission and documentation

All admissions will be considered done after receiving full fees and with complete documentation (educational documents). If a student does not provide all concerned documents within the given timeframe, as per the date finalised by the Institute, the Institute holds the right to cancel the admission of the student then and there. In such a case the Institute's service charges will not be refundable, but the fees will be refundable as per the Institute's guidelines.

The Institute holds the right to cancel the admission of any student who fails to pay the fees on or before the due date.

Where a student fails to submit all the documents mentioned in the respective Provisional Admission Letter of the Institute before the last date declared by the Institute, or where the student is not contactable on the email address and phone number provided by them and no information has been given, the Institute holds the right to hold or cancel the admission of the student.

Keeping your contact details current

The email address and mobile number recorded in Academica ERP are the addresses at which the Institute gives notice. Tell the office when either changes. A notice sent to the recorded address is treated as delivered.

Admission is provisional until the file is complete

A Provisional Admission Letter secures a place; it does not complete the admission. Until the fees are paid in full and every document named in that letter has reached the office, the place remains provisional and may be withdrawn.

04

Accuracy of the information you give us

In the process of admission, it is the student's responsibility to ensure that all the documents and information provided to the Institute are true and accurate. This includes the date of birth, the name as it is to appear in board records, the category and the particulars of previous schooling.

Where information later proves to be untrue, incomplete or misleading, the Institute may correct the record, may withhold or cancel the admission, and — where a board registration has already been made on the strength of it — may be unable to correct the entry at all. Corrections to name, parentage or date of birth after registration with SEBA or AHSEC are governed by the board's rules and its fees, not by the Institute.

05

Fees and payment

The fee is calculated and charged on a monthly basis. In case of refund, service charges, registration charges and other charges are not refundable under any circumstances, but the fees will be refundable as per the Institute's guidelines.

Fees are payable by the due date published for the session, at the school office or online through Academica ERP and the school app. The fee structure for each class is published on the Fees page and is revised for each academic session.

  • Absence from school, for any reason including illness, does not reduce the fee for the period.
  • Amounts payable to a board — SEBA or AHSEC registration and examination fees — are collected by the Institute and remitted onward, and cannot be recovered once remitted.
  • Where fees remain unpaid, the Institute may withhold results, certificates and the Transfer Certificate until the account is settled.

06

Cancellation and refund

Fees and service charges are non-refundable in each of the following cases, whichever applies first.

  1. 01

The admission form has been processed by the Institute

  2. 02

An enrolment number has been issued

  3. 03

The fee is paid after the enrolment number is issued

  4. 04

Seven days have passed since the submission of the fee

  5. 05

The amount is an instalment or a pending fee of an earlier course

How the Institute applies these rules in practice — the position by fee head, withdrawal and transfer, failed or duplicate online payments, and how long a refund takes — is set out in the Refund Policy. Where the two differ on a point, these terms govern.

07

Conduct, discipline and continuing enrolment

A student admitted to the Institute is expected to observe the General Rules, the rules of the hostel and transport where those services are used, and the reasonable instructions of the staff. Attendance, uniform, punctuality and conduct requirements are part of the contract, not advisory.

The Institute may, following a fair enquiry proportionate to the matter, warn, suspend or require the withdrawal of a student for serious or persistent breach of its rules, for conduct that endangers others, or for damage to school property. The parent or guardian will be informed and heard before a decision to require withdrawal is taken. Fees already accrued remain payable, and section 06 governs any refund.

Damage to school property, or the loss of a library book, laboratory equipment or an RFID identity card, is recoverable from the student's account at cost.

08

Using this website

By accessing, using or observing this website you agree to the applicability of these Terms of Use and Conditions, and you are aware of the matters we have disclaimed here. If you do not accept them, please do not use the site.

You may read, print and share the pages of this website for personal, educational and non-commercial purposes. You may not:

  • use the site, its forms or its contact addresses to send unlawful, defamatory, obscene or misleading material, or unsolicited commercial messages;
  • attempt to gain unauthorised access to any part of the site, Academica ERP, the school app or any account, server or network connected to them;
  • scrape, harvest or systematically extract staff or student details, photographs or contact information, whether by automated means or otherwise;
  • introduce a virus, worm or other malicious code, or take any action that imposes an unreasonable load on the infrastructure;
  • impersonate the Institute, its staff or a student, or use its name, crest or logo in a way that suggests an association or endorsement that does not exist.

The Institute may restrict or withdraw access to the site, or to a service reached through it, where it reasonably believes these terms have been breached.

09

Academica ERP, the school app and online payments

Academica ERP and the school app are provided to parents and students for admissions, attendance, fees, results and school communication. Access is personal to the account holder.

  • Your credentials are yours to protect. Do not share the login with anyone outside the family. Tell the office at once if you believe an account has been used without your knowledge.
  • Payments pass through a bank or gateway. A payment is recognised when the Institute receives confirmation from the gateway, not when a debit appears on your statement. Keep the transaction reference.
  • Failed and duplicate payments are put right without charge. The position is set out in the Refund Policy.
  • Availability is not guaranteed. The ERP, the app and this website may be unavailable during maintenance or for reasons outside the Institute's control. Where an online channel is unavailable on a due date, the office will accept payment directly.

The school app is distributed through Google Play and is additionally subject to the store's own terms. Records shown in the ERP are provisional until confirmed by the office; the school's own register is the authoritative record.

10

Intellectual property

The content of this website — text, page design, photographs, illustrations, documents and downloads — belongs to the Institute or to those who have licensed it to the Institute, and is protected under the Copyright Act, 1957.

The name St. John's, the school crest, the Johnian logo and the motto “Let Your Light Shine” are marks of the Institute. They may not be reproduced, adapted or used on any publication, uniform, merchandise, website or social media account without the written permission of the Principal.

Extracts may be quoted for study, reporting or research with a reference to this website. Anything more — republication, commercial use, or the use of a photograph of a student — requires permission from the office.

Syllabus material, question papers and publications of SEBA, AHSEC or NCERT reproduced or linked here remain the property of those bodies.

11

Photographs, film and student work

The Institute photographs and occasionally films school events — assemblies, sports, cultural programmes, excursions and prize-giving — and publishes a selection in the Gallery, in the prospectus, on the school app and on the school's social media, together with student work and the names of prize-winners.

Consent for this is taken on the admission form. A parent or guardian may withdraw it at any time by writing to the office; the Institute will then stop using the material going forward and will remove it from the website and the app within a reasonable period. Withdrawing consent does not affect a printed publication already distributed, and does not extend to material in which the child is not identifiable.

Parents and visitors may photograph their own children at school events. Publishing images of other people's children on social media without their parents' consent is not permitted on school premises.

How images and personal data are handled and how long they are kept is described in the Privacy Policy.

12

Disclaimer and accuracy of information

All information contained in or accessed through this website is provided on an “as is” and “as available” basis. No warranty of any kind, implied, express or statutory — including but not limited to warranties of title, merchantability, satisfactory quality, non-infringement of third-party intellectual property rights, fitness for a particular purpose, warranties of performance, and freedom from computer viruses and other malicious code — is given in conjunction with such information, its veracity, accuracy, adequacy, completeness or reasonableness, or with this website in general.

The information and materials on this website are subject to change at any time without notice. Fee structures, dates, results, staff lists and syllabus details are published in good faith and may be superseded; the position confirmed by the school office in writing prevails over anything on this website.

Nothing on this website is an offer of admission, a guarantee of a place, or a guarantee of any academic result.

13

Third-party links and services

This website links to services the Institute does not control — among them SEBA and AHSEC, Academica ERP, Google Play, YouTube for the video gallery, and the websites of government departments. Those links are offered for convenience.

The Institute does not endorse, and is not responsible for, the content, availability, security or practices of any external site. Once you follow a link you are governed by that site's own terms and privacy notice. If you find a link that is broken, out of date or inappropriate, please tell the office.

14

Limitation of liability

To the extent permitted by law, the Institute is not liable for indirect or consequential loss arising from the use of this website, from an inability to access it or the ERP, or from reliance on information published on it that has since changed.

The Institute is not liable for a failure to perform its obligations where the cause is beyond its reasonable control — including an act of God, flood, storm, epidemic, an order of a public authority, a disruption of public order, a failure of power or telecommunications, or the closure of the school by direction. Where teaching continues by other means during such a period, fees remain payable.

Nothing in these terms limits any liability that cannot lawfully be limited, or affects a student's or parent's statutory rights — including rights under the Right of Children to Free and Compulsory Education Act, 2009 and the Digital Personal Data Protection Act, 2023.

Students remain responsible for their own belongings on the school premises, on transport and in the hostel.

15

Privacy of personal information

Privacy of personal information is described separately. The Privacy Policy sets out what the Institute collects, why, who processes it on the school's behalf, how long it is kept and the rights available under the Digital Personal Data Protection Act, 2023. The Cookie Policy covers the cookies this website sets and how to refuse the optional ones.

Both documents are part of these terms. Using this website, the ERP or the school app means the personal data described in them will be handled as those notices set out.

16

Governing law, grievances and jurisdiction

These terms are governed by the laws of India. The Institute is affiliated to SEBA and AHSEC, Guwahati, and is bound by the regulations of those boards in matters of registration, examination and results.

Raise a grievance with the school office first — most matters are settled there. If the answer does not satisfy you, write to the Principal, who will reply in writing within 30 days. Only where a matter cannot be resolved in that way do the courts at Baksa, Assam have jurisdiction.

Severability

If a provision of these terms is held to be invalid or unenforceable, the remaining provisions continue in force. A delay by the Institute in enforcing a term is not a waiver of it.

17

Changes to these terms

These terms are reviewed for each academic session, and at any time a rule, a fee head or a service changes. The version in force is the one published on this page on the date the place was accepted or the fee was paid, and the date of the current version is shown at the top.

Material changes are announced to parents through the school app and a circular. Continuing to use the website, the ERP or the school app after a change is published means the revised terms are accepted.

Ask before you commit, not after

Every clause on this page has a person behind it in the school office. If a term is unclear, or your circumstances do not fit neatly within one, bring it to the office before accepting a place — it is far easier to settle a question then than after a fee has been paid or a document deadline has passed.

The Principal replies to written grievances within 30 days
